This Privacy Policy explains how and why the Company collects, uses, discloses or otherwise processes your information, including personal information, through our websites or applications (collectively, the “Services”), as well as offline when you interact with us (such as through written or verbal communications between you and the Company). It also describes the policies and practices we have in place with respect to the retention and protection of your personal information and the choices and rights available to you regarding your personal information. Each time you access or use our Services or otherwise interact with the Company, you consent to the collection, use, disclosure or other processing of your personal information by the Company in the manner specified in this Privacy Policy. If you do not agree with this Privacy Policy, you should not use the Services.  

We may supplement this Privacy Policy with additional information relating to a particular service, product or transaction with you, such as the privacy policy for software that may accompany our products. This Privacy Policy does not apply to any Company websites that have their own Privacy Policy, such as Privacy Policies that may be posted on the websites for our international operations.

Website Analytics Information.
We use Google Analytics to ensure website functionality and improve our websites.  This software may record information such as your IP address, location, date of birth and gender, browser type and language, operating system, access time, duration of visit, pages you view within our website, search terms you enter, and other actions you take while visiting us, the pages you view immediately before and after you access our website, how often you use our website, aggregated usage and performance data, application errors, and debugging information.  Google Analytics is owned and controlled by Google LLC.  Data collected by Google is subject to its privacy policy. 4. How We Share or Disclose Your Personal Information

The following describes our policies for disclosing or sharing your personal information with others.

Disclosure of Personal Information to Service Providers and Certain Others. We may disclose, transfer or make available personal information to the following entities: our parent company, affiliates, subsidiaries or divisions (“Affiliates”) and individual colleagues (“Employees”); service providers; trusted business partners; our professional advisors, including lawyers, insurers, accountants and auditors (“Advisors”); and official government bodies, such as government agencies, local authorities, regulators and the police (“Official Government Bodies”) as necessary for the purposes described in this Privacy Policy, including: 

  • To Provide Services on Our Behalf: We may disclose or transfer personal information to service providers who need your information to provide services to us or on our behalf, such as processing or fulfilling orders, processing payments, providing customer service or warranty support, maintaining our computer systems, providing security or fraud detection services, providing analytic services, providing marketing and advertising services, and administering marketing and advertising campaigns, or providing similar services.  They are provided only the information necessary to perform the services. In addition, we require, among other things, that they use and disclose the information only for the purpose for which we disclose or transfer it to them and maintain adequate privacy protections and security standards in accordance with applicable law and consistent with the terms of this Privacy Policy. 
  • To Perform Job Function: We may disclose personal information to, or allow access to personal information by, our Employees who need it to do their job functions, such as fulfilling orders and processing payments, and providing customer service or warranty support. 
  • To Obtain Professional Advice: We may disclose personal information to our Advisors for the purposes of managing risks, obtaining professional advice, exercising legal rights or defending against legal claims, etc. 
  • Security and Fraud Detection: We may disclose personal information for our security and fraud detection services including detecting and investigating security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • Functionality & Debugging: We may disclose personal information to engage in debugging to identify and repair errors that impair existing intended functionality.
  • Advertising and Marketing Services: We may disclose personal information to provide advertising or marketing services on our own behalf.
  • Quality Control & Improvement of Products and Services: We may disclose personal information to verify, maintain, and improve our products and services.
  • Legal Compliance: Where required or permitted by applicable law, we may disclose your personal  information to Official Government Bodies including (a) to comply with any legal process; (b) to respond to their requests; (c) to enforce our terms and conditions; (d) to protect our operations, rights and property, and/or the rights and safety of you or others; and (e) to allow us to pursue available remedies or limit the damages that we may sustain.  
  • In Connection with a Reorganization or Similar Business Transaction: We may disclose personal information with a third party in connection with or during negotiation or on completion of any reorganization, acquisition, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings). Your personal information will be disclosed in accordance with applicable law and will only include information that is relevant and necessary to facilitate or complete the transaction.
  • Other Purposes: We may disclose personal information for other business purposes described above in the section entitled “WHY WE COLLECT YOUR PERSONAL INFORMATION”, and/or as otherwise consented to by you or as permitted or required by applicable law.

Sensitive Personal Information. We only use and disclose sensitive personal information for purposes identified herein. We do not use or disclose sensitive personal information for purposes other than those identified purposes, without your express consent, unless otherwise permitted or required by applicable law. 

Cross Border Transfers. Because we operate as part of a global business, we may transfer or disclose your personal information to Canadian, US and foreign Affiliates and service providers who provide services and may use, disclose or store personal information on our behalf as described under “HOW WE SHARE OR DISCLOSE YOUR PERSONAL INFORMATION”. Our Affiliates and service providers may have access to your personal information on a confidential basis to the extent necessary to perform their obligations. We may also authorize our Affiliates and service providers to collect information on our behalf. Some Affiliates and service providers may be located outside of your province or territory or outside of Canada, including in the United States and Mexico, whose privacy laws may differ from those applicable in your province or territory. For Quebec residents, please note that it is possible that your personal information may be communicated outside of Quebec. In circumstances where your personal information is transferred or disclosed to a country outside of Canada, government or regulatory agencies, courts and law enforcement of that country may be able to obtain access to your personal information in accordance with the laws of that country. Before we transfer or disclose your personal information, we implement reasonable safeguards to protect your personal information in accordance with applicable law, as described under “HOW WE PROTECT YOUR INFORMATION”. These measures may include the conduct of a privacy impact assessment to evaluate the risk associated with the disclosure or transfer of personal information outside your province or territory or Canada. In addition, we enter into written agreements with our service providers that require our service providers to, among other things, comply with applicable laws and maintain appropriate privacy and security safeguards to protect your personal information wherever it is used or stored. Disclosure of Aggregated, De-Identified and/or Anonymous Information. We may aggregate, de-identify and/or anonymize your personal information, in accordance with applicable law, so that it can no longer be linked to you.  Subject to applicable laws, we may use and disclose aggregated, de-identified or anonymous information for any serious and legitimate purposes at our sole discretion.

5. How We Protect Your Information

We use reasonable security measures, including physical, administrative, and technical safeguards to help us protect your personal information from loss or theft, and from unauthorized access, use, disclosure, copying or modification. These measures may include encryption, security certificates, access controls, information security technologies, policies, procedures, employee privacy and data security training, privacy impact assessments, and other information security measures to help protect your information. We also use contractual provisions and other measures to require our suppliers, service providers and business partners to whom we transfer or disclose personal information to, among other things, maintain appropriate security safeguards to protect such information from loss or theft, as well as unauthorized access, use, or disclosure. 

6. How Long We Keep Your Personal Information

We will retain your personal information for as long as necessary to fulfill the purposes for which we collected it or as otherwise required by applicable law.  To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal requirements.  If we no longer require your personal information for these purposes, we will delete, destroy or anonymize it in accordance with applicable law, unless we are required by law to keep it for a longer period.

7. Your Privacy Rights

Consent: Generally, we obtain your express or implied consent appropriate for the type of personal information being collected, used or disclosed in accordance with this Privacy Policy and applicable law, unless third parties from whom we obtain your information have obtained your consent or unless otherwise permitted or required by applicable law. You have the following rights with respect to your personal information held by us in accordance with applicable law: 

  • Right to Withdraw Your Consent: You have the right to withdraw or change your consent to our collection, use and disclosure of your personal information at any time, subject to legal or contractual restrictions and reasonable notice. If you withdraw or change your consent, we may not be able to provide you with the products or services you have requested. Upon receipt of your request, we will explain the implications of withdrawing or changing consent to assist you in your decision.
  • Marketing Communications: You may withdraw your consent to our use of your personal information for marketing purposes as described below under “YOUR CONTROL OF YOUR INFORMATION”. Please note that even if you opt out of receiving marketing communications, we may still contact you for transactional or other purposes permitted or required by law.
  • Cookies, Interest-based Advertising and Analytics: You may withdraw or change your consent to the use of certain cookies or similar technologies on our website at any time as described above under “HOW WE COLLECT YOUR PERSONAL INFORMATION”.
  • Right to Access: Upon request, you have the right to be informed of the existence, use, and disclosure of the personal information we hold about you and to be given access to or obtain a copy of that information, subject to exceptions permitted by applicable law. If we are unable to provide you with access to personal information we hold about you, we will explain the reasons why. You may be required to provide us with sufficient information to help us confirm your identity and to permit us to provide an account of the existence, use, and disclosure of your personal information.
  • Right to Correction: If your personal information in our possession or under our control is inaccurate, incomplete or equivocal, you have the right to have the information amended. Depending on the nature of the information, this may involve the correction, deletion or addition of information. Where appropriate, the amended personal information will be provided to third parties having access to the information in question. If a challenge is not resolved to your satisfaction, we will record the substance of the unresolved challenge and, when appropriate, transmit the existence of the unresolved challenge to third parties having access to the information in question.
  • Right to De-indexation: Residents of Quebec have the right to request us to stop disseminating their personal information or to de-index any hyperlink attached to their name that provides access to the information, if the dissemination of the information contravenes the law or a court order. In addition, they have such rights or the right request re-indexation where the dissemination of the information causes serious injury to their right to privacy or reputation and the conditions of applicable privacy legislation are met.
  • Right to Portability: Effective September 22, 2024, unless doing so raises serious practical difficulties, residents of Quebec have the right, on request, to have computerized personal information collected from them released to them in a structured, commonly used technological format and to have such information released to any person or body authorized by law to collect such information.
  • Automated-Decision Making: If you are a resident of Quebec and we use your personal information to make a decision based exclusively on an automated processing of such information, we will inform you accordingly not later than the time we inform you of the decision. In addition, upon request, we will also inform you of the personal information used to make the decision, the reasons and the principal factors and parameters that led to the decision, and your right to have the personal information used to make the decision corrected. You will also have the right to submit observations to a member of our staff who is in a position to review the decision.
  • Right to Challenge Compliance: If you have any questions, comments or complaints about our privacy practices or this Privacy Policy, please contact Kim Collins, Sr. Governance & Compliance Analyst, as described below under “CONTACT INFORMATION”. If your complaint is found to be justified, we will take appropriate measures, including, if necessary, amending our policies and practices.

How to Exercise Your Rights: You may submit a request regarding your privacy rights by contacting Kim Collins, Sr. Governance & Compliance Analyst, by email at privacy@cloroxhomeappliances.com or by phone at (800) 992-4616. Any request to exercise these rights will be handled in accordance with the terms of applicable privacy legislation. In order for us to respond to or fulfill your request, and to protect the confidentiality of your information, you may be required to provide appropriate identification in order that we can verify your identity.

If you are not satisfied with our response to your questions, comments, complaints or privacy request, you may also have the right to file a complaint with or ask for a review by the federal or applicable provincial privacy commissioner, subject to any conditions set out in applicable privacy legislation.

8. Stripe Services

We use Stripe for payment, analytics, and other business services. If you make payment through our website, Stripe will collect and process your personal data, including your credit card information and identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection and prevention. 9. Zendesk Services

We use Zendesk to provide customer support and warranty services to our customers, and for other business services. If you contact us regarding a transaction or product or for other customer support, your personal information will be collected, stored, used and/or processed by Zendesk, as permitted by and in accordance with applicable law, to provide these services to us.

Our websites may contain links to third-party websites (such as Facebook® or Twitter®) and services (such as Apple Pay) and to advertisements by third parties (collectively, “Third-Party Features”). Links to Third-Party Features are provided for your convenience only. Your use of a linked Third-Party Feature is governed by the privacy policy of the company providing the Third-Party Feature, not by this Privacy Policy.

11. Information from Children

The Company does not direct its websites or applications to children under fourteen (14) years of age. No information should be submitted to our websites or applications by persons under 14 years of age.  Persons under the age of 14 are not allowed to register for newsletters, clubs or activities. Individuals under eighteen (18) should consult with their parent or guardian about the use of the Company’s websites or applications for their benefit.  Persons under 18 years old are not allowed to make purchases or participate in contests. When appropriate, the Company may ask you to indicate your date of birth to verify compliance with the age requirements set forth herein.

The Company does not knowingly collect information from persons under 14 years of age or provide any personal information from such persons to any third party for any reason whatsoever. The Company does not allow persons known to be under 14 years of age to receive direct marketing communications from the Company.

12. Your Control of Your Information

You have certain choices regarding the use of your information for marketing purposes. Those choices include the right to deactivate any account you have with the Company and to opt-out of receiving any marketing materials from the Company.  The methods by which you can exercise your options to deactivate your account or opt-out are as follows: 

Deactivate your account:  If you have an account with us, you may deactivate your account by emailing us at privacy@cloroxhomeappliances.com  and requesting that we deactivate your account.

Opt-Out of Promotional Email Communications: You may opt out of promotional email by clicking on the “unsubscribe” link   in the email, or by emailing us at privacy@cloroxhomeappliances.com, and explaining the email or types of promotional emails that you would like to unsubscribe from. Please also note that if you have previously added your contact information to the mailing list of one of our clients or partners and later withdraw your consent, you will have to contact that third party to request removal from that third party’s mailing list.

Opt-Out of Promotional Text Message Communications: You may opt out of promotional text messages by clicking on the “unsubscribe” link in the text message, or by emailing us at privacy@cloroxhomeappliances.com, and briefly describing the text messages or types of promotional text messages that you would like to unsubscribe from. 

Opt-Out of Promotional Mail Communications: You may opt out of promotional mail communications by following   instructions provided in the mailing, or by emailing us at privacy@cloroxhomeappliances.com, and briefly describing the mailing that you would like to unsubscribe from.

13. Exclusion of Anonymous Information

Information which is aggregated and anonymized in accordance with applicable law in such a manner that the identity of the natural person to whom the information relates can no longer be identified shall not be considered personal information and shall not be subject to the rights and responsibilities set forth in this Privacy Policy. 

14. Company Ownership of Information

All opinions, ideas, suggestions, and other feedback submitted to the Company, may be used by the Company without any restriction and free of charge, and nothing contained in this Privacy Policy shall limit or otherwise affect said rights.
